IR35 Reform Repeal Scrapped in Major U-Turn by Chancellor

On 17 October 2022, in a dramatic reversal, Chancellor Jeremy Hunt announced the government would no longer repeal the 2017 and 2021 IR35 reforms—scrapping a key pledge made just weeks earlier in the now-infamous mini-Budget.

The off-payroll U-turn is part of a £31 billion package of emergency measures to stabilise UK finances, but it has sent shockwaves through the contracting sector.

A Missed Opportunity

The repeal would have returned IR35 status decisions to contractors working via personal service companies (PSCs), relieving end clients of tax liability and reducing administrative burdens. Instead, the complex off-payroll working rules remain—requiring medium and large companies to determine IR35 status and carry potential tax risk.

The reversal puts many contractors and businesses back to square one, facing uncertainty, compliance costs, and reduced engagement flexibility.

Business Impact

  • Contractors lose control of their IR35 status unless engaged by a small company.
  • Clients resume responsibility for making complex status determinations.
  • PSC engagements may decline, as firms shy away from perceived risks.

Despite earlier government acknowledgements that the IR35 reforms imposed "unnecessary cost and complexity," the repeal has been cancelled to save an estimated £2 billion annually.
